Acceptable Use Policy

While we do not actively monitor the way you use our services, you must adhere to the following guidelines we have established. We have the right to terminate or suspend your account or halt the dissemination of information in any means we deem appropriate if you do not adhere to the guidelines set forth in this document:

General
These Policies are designed to assist in protecting the Service, our Customers, and the Internet community as a whole from improper and/or illegal activity over the Internet. Customers are expected to behave in a reasonable fashion and to adhere to commonly accepted practices of the Internet community.

Spamming
Customers may not use services to send any unsolicited messages also known as "spamming". Spamming is strictly prohibited and when a complaint is received Sendmetric will investigate the matter and determine whether the e-mail recipients were received through an "opt-in" e-mail list.

Excessive Usage
Customer accounts with unusual activity excessively beyond the service level paid for will be notified and if deemed a risk to the resources of Sendmetric, will have their accounts suspended. Customers that exceed their purchased bandwidth and service arrangements will be charged for the extra bandwidth or service usage.

Intellectual Property Violations
Engaging in an activity that infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, corporations, or other entities is strictly prohibited. Also customer adheres that they will not engage in activity that violates privacy, publicity, or other personal rights of others.

Other Activities
Engaging in activities, whether lawful or unlawful, that Sendmetric determines to be harmful to its customers, operations, reputation, goodwill, or customer relations.
